ALDE MEP Marietje Schaake respons to Commission transparency proposal for ISDS

The European Commission today proposed to apply UN rules on transparency in investor-state dispute settlement (ISDS) cases to the 1300 bilateral investment treaties that European Member States have with other countries. Starting on 17 March, the Member States can sign a convention to put this into effect. This would mean that ISDS cases conducted under the existing treaties would be open to the public and that documents would also be published. Member of the European Parliament Marietje Schaake (ALDE/D66) responds: "It is good that the European Commission is taking action to look for solutions to the problems surrounding ISDS. ISDS has been in the spotlight in the context of the negotiations of the EU-US trade agreement, TTIP. However, the need for more transparency, independence of arbitration judges and room to regulate for governments is broader than only TTIP, because European Member States already have 1300 agreements which contain ISDS. On 17 March, European governments must show that they take the criticism of ISDS, a mechanism that is often used by European companies, seriously and that they are willing to act to improve it. Increased transparency is only a start, more will be needed." "With this proposal Cecilia Malmström, the new Trade Commissioner, shows that she takes citizens' concerns seriously. Previously, she launched a transparency initiative to make more texts public from the negotiations with the US. She is also trying to convince the Member States to make the negotiating mandate for the Trade in Services Agreement (TiSA) public. Because the mandate is given by the governments, only they have the power to make it public. Malmström wrote a letter to the Council with this request today."
